General Terms and Conditions

The System

  • The Bahiazul Resort Fuerteventura online booking system allows making real-time reservations for the Villas de Bahiazul Resort Fuerteventura, for any time of the year, in accordance with the conditions set out below.
  • You must be at least 18 years of age in order to perform any operation.
  • If paying for a booking with a credit card, it is essential to provide the card number and, if requested, its security code in order to confirm and guarantee your reservations, along with a contact telephone number and email address so you can receive information concerning the status of reservations.
  • All rates and promotions are subject to their own sales conditions, as posted. You can find these conditions on the Bahiazul Resort Fuerteventura website: bahiazul.com

Reservations

  • To confirm the booking, a security deposit in the amount of 30% of the total value of the booking indicated by the system is required as a provision for the cost of preparations and arrangements made before arrival at the Villa and its individual facilities.
  • The occupancy in each Villa will be a minimum of 1 person and a maximum of 6 as a general rule.
  • The villas generally consist of three bedrooms, each of which will be opened according to occupancy: for 1 or 2 guests, only the master bedroom will be opened; for 3 or 4 guests, both the master bedroom and the 3rd bedroom will be opened; and for 5 or 6 guests, all three bedrooms in the villa will be opened. If your personal circumstances require other arrangements, please notify us at least 7 days in advance by emailing booking@bahiazul.com and please note that there will be an additional charge for opening the bedrooms.
  • Babies under 2 years old imply no additional cost. The child age to be entered when consulting prices and/or final reservation is the child’s age on the date of arrival at the hotel and must be the one specified in your identity document. The hotel can request a valid passport/identity card. In case of not presenting a valid document or that the age does not correspond with the data of the reservation, during the check in, the hotel reserves the right to request the payment of the adult supplement.
    • Babies ages: Up to 1.99 years (included).
    • Children ages: From 2 to 11 years (included).
    • Adults ages: 12 years and above.
  • The minimum stay is of 4 nights. In high season (Easter, Summer, Christmas) the minimum stay is 7 nights.
  • Experiences (excursions, services and adventures) contracted through the website bahiazul.com or via email booking@bahiazul.comare 100% non-refundable. In the event of inability to attend, 100% of the amount will be charged to the client’s account.
  • Benefits for clients who book through the bahiazul.com website
    • Bahiazul Resort Fuerteventura would like to thank its clients for their loyalty and trust. To show our gratitude, we would like to reward those who book through the website www.bahiazul.com by offering them, among other things, a discount at the SPA and RESTAURANT during their stay.
  • Conditions for the application of discounts on purchases:
    • A discount of 10% (ten per cent) will be applied to all purchases made by direct clients, during any stay, at both the BAHIAZUL SPA and the BAHIAZUL RESTAURANT.
    • In order to benefit from the discount, guests must select ‘Villa Charge’ as their method of payment.
    • The discount will be applied at check-out and only at reception.
    • The discount does not apply to third party products or services, e.g. transfers, excursions, even if these are offered at the hotel.
    • The discount cannot be combined with other promotions.
    • Bahiazul Resort Fuerteventura reserves the right to cancel this programme at any time without prior notice.

Reservation Confirmation

  • The system will provide the booking information and a “locator” code, to be used for any further operations or communication.
  • The booking confirmation, provided by the system, will be subject to the validation of the credit card information or, if applicable, receipt of the wire transfer. Therefore, if there are any errors in the credit card information provided, the booking will be cancelled.
  • Bookings made by wire transfer will provisionally be considered pending until the wire transfer to the Bahiazul Villas & Club account is confirmed.
  • You will receive the details regarding the validity of the pre-booking in the confirmation email sent by Bahiazul Resort Fuerteventura upon receiving your request.
  • When checking “Availability and price” and in the “Booking Confirmation”, the total cost of your stay will be displayed.
  • Availability is only guaranteed for reservations made through the direct payment system (ex: credit or debit card online or PayPal).
  • The company reserves the right to correct the content of a reservation if an misprint or obvious error (Eg .: in customer confirmation appears a concept that has not been selected or paid for) is evident.

Modification, Cancellation of Reservations and No Shows

  • A deposit of 30% of the total amount of the booking is required in advance. You can cancel free of charge up to 7 days before arrival. If you cancel your reservation more than 6 days before the arrival date, the deposit paid will be valid for a new reservation during the following calendar year.
  • Modification of dates. Between 59 and 10 days prior to arrival: It is possible to modify the dates of arrival and departure, provided that there is availability for the requested change.
  • Any modification regarding the number of guests, the type of villa or any other aspect that does not involve changing the dates of the reservation, will be requested by email to booking@bahiazul.com and will always be subject to availability and the corresponding supplement, if applicable.
  • Exceptions: These general cancellation conditions do not apply and therefore no refunds will be made for bookings made during the Easter, Summer (10 July – 15 September) and Christmas (23 December – 6 January) periods of each year.
  • Once the check in has been completed, no cancellation or modification of the reservation can be made, therefore if the client decides to bring forward his departure date or modify any of the conditions of his reservation (number of nights, number of persons, type of villa, type of accommodation, etc.), he will not be entitled to any refund.
  • The General Conditions of Cancellation will not be applicable to rates with offers or promotions, in these cases the particular conditions corresponding to the same will be applied.
  • These conditions are only applicable to the end client. In no case for agencies or intermediaries.

General

  • No pets allowed.
  • The villas have a private parking space which must be used. The use of the outdoor parking spaces is limited to the minimum time necessary for loading and unloading (luggage, packages, shopping, etc.), and their use is forbidden during the guests’ stay in the villa.
  • Performing any operation implies full acceptance of these General Terms and Conditions.
  • These conditions are generally applicable, except for those promotions that list specific conditions for cancellation, modification or refund, other than the foregoing.
  • The prices shown do not include taxes from those regional or local authorities that establish specific rates for stays in tourist establishments located within their Autonomous Communities. As a general rule, those fees shall be paid directly by the customer prior to his or her departure from the property.
  • Once check in is complete, the total amount for the stay must be paid in full. A credit/debit card must be provided as a guarantee.

Dress Code:

  • Whilst we want our guests to be as comfortable as possible, we would like to stress the need for a minimum level of consideration for other hotel guests.
  • Breakfast and lunch: casual dress, but under no circumstances will guests be allowed to enter the restaurant barefoot or shirtless.
  • Dinner: Under no circumstances are guests permitted to dine in swimming trunks and/or flip-flops.
  • Gentlemen and children: They may wear shorts, such as Bermuda shorts, but only if they do not look like swimming trunks or gym shorts. Tank tops are not allowed. Flip-flops are not allowed and must be closed.
  • Ladies: open sandal-type shoes are permitted.
  • Drinks during dinner are not included in half board.

Villas with Connecting Door:

  • There are a limited number of villas with a connecting door between the master bedroom and the second bedroom (often requested by families with children). To guarantee the availability of this type of villa, the client must request it by email at least 20 days before arrival and pay a supplement of €15 per day of stay at check-in.
  • Bahiazul Resort Fuerteventura reserves the right to enforce liability for the misuse of this system or breach of the provisions contained in these General Terms and Conditions. The user shall be solely responsible for any defective, partial or erroneous use of the service, or in the event that someone uses the service in their name or on their behalf, using their login and password.
  • The material on this Bahiazul Resort Fuerteventura website is copyrighted and is the property of Bahiazul Resort Fuerteventura. Access to the website does not imply a license to reproduce and/or distribute. This is not permitted without the written consent of Bahiazul Resort Fuerteventura.
  • Should any dispute arise, the parties, expressly waiving their own jurisdiction, submit to the jurisdiction of the Courts of Fuerteventura.
  • Bahiazul Resort Fuerteventura is not liable for any disruption, failure or inaccessibility for any other reason of the operating system that may occur due to disruptions, failures or the inaccessibility of any telecommunications services or other accessories, unrelated to this entity and required for the operation thereof.

Payment Methods

  • The payment of the reservation will be made in the currency of the hotel, which is the EURO (€).
  • The prices in other currencies that may be shown on the website during the booking process are merely informative and are subject to the variations of the exchange rate of the day.
  • The accepted payment methods include debit/credit cards: Visa, MasterCard, and American Express, and in electronic commerce, payment is also accepted through PayPal.
  • Limitation to cash payments: In accordance with Law 11/2021, of July 9, on measures to prevent and combat tax fraud:
    • Transactions equal to or exceeding 1,000 euros or its equivalent in foreign currency cannot be settled in cash if the payer is a tax resident in Spain.
    • The limit is 10,000 euros or its equivalent in foreign currency for natural persons who can prove non-residency for tax purposes in Spain and are not acting in a professional or business capacity.

Right of Withdrawal

  • As established in Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users, our entity is protected by the exception indicated in Article 103.l: “The provision of accommodation services for purposes other than serving as housing, transportation of goods, rental of vehicles, food or services related to recreational activities, if the contracts provide for a specific date or period of execution”.
